We should deal with suspects, of course, but there's a way to do it and still obey the Constitution...

REALLY? Regret that the Constitution was upheld by the Supreme Court, Antonin???? What a d*ck.......... :thumbdn: :thumbdn: :thumbdn: |
Antonin believes in upholding the constitution as written by the founders of our country, not through modern day interpretations. I agree. Enemies of the state and non-citizens should be extended no protection by the constitution.
|
Right modern day BS interpretations is ruining us all. :( My further response is IN THE LINK!!!!
NOW STOP POSTING POLITICS IN THIS AREA BEFORE PATRICK MOVES THE THREAD FOR THE 10th TIME!!!! USE THE LINK GUYS!!!! |

That is a good point, sir..... EDIT: Is a US base considered US soil?? Even if it's not, agents of the US should uphold the constitution to the best of their ability, regardless of where they are, IMO. We don't have the Constitution because we think it's a good idea for US citizens, but because we think it's a good idea, period. Edit: and umm, this is S2000 related, because it umm... affects the price of gas, which is important to all of us S2000 drivers. Or something... :suspect:  |

1. Yes it is. And US law applies within that base.

It does not matter if it's not in the US. There is no question nor paradox.
The text is clear "within its jurisdiction" is pretty clear. Clearly Gitmo is within US jurisdiction. If not, the US has no right to hold prisoners there, which they are doing. This is not the US trying to impose laws on another country. :thumbdn: hehe, Overbooster, just get a membership so we can continue this in the other thread! GOOD CATCH!!!!!!   |

Guitmo is not in the US, so the question of whether our laws extend that far exists.
Indeed, if a US service member were to go out of the base and murder a national then come back on base, the local police is NOT allowed to pursue him into the installation. |

There is no question, actually. US law is THE law on a US base in a foreign country. The host nation has no jurisdiction.

Heheh. I'm oversimplifying, but basically a military base, while not considered US soil, still adheres to certain US laws (the Constitution doesn't always apply) depending on what's agreed upon with the Status of Forces Agreement with the host nation.
It's different depending on where you are. |

:ponder: :ponder: |
Brian.... I'm not sure that makes it US SOIL, in which case that changes things. We have embassies around the world which this holds true (all of what you said). However this is NOT always the case <EDIT> AS WOLFGANG NOW ALSO STATED BEFORE I POSTED IN TIME. So I'm not so sure your fully correct.... Perhaps?
You believe agents should uphold and enforce the US constitution wherever they are? So now wherever we walk is US LAW? I'm assuming you meant if we setup some kind of temp. situation like a base or whatever. Still. I feel their laws should be respected in some cases and we are simply a guest. I went to Korea (and I know you've been to Japan) and things work between both laws. Greg |
I'm always behind in typing...dammit
What we can then say from this is that INDEED the Constitution does not and can not always be applied. So now we can say to the 14th. EVERYONE means EVERY US CITIZEN and possibly more , but not necessarily, Objections? If so, consider that by doing so we would be IMPOSING it upon others who possibly do not wish to accept it. That said should we then be forced to impose the parts that also protect them from us if we can't impose the other parts on them? My answer is a simple NO. |

[QUOTE=Nicotunes,Jun 13 2008, 01:47 PM] I disagree.

The 14th clearly applies only to US citizens. This is proven by the liberties (again which you argue apply to everyone) that are denied to illegal aliens. Are they not considered "anyone" by your arguement...yes clearly.
In the applicable section of the 14th Amendment, it CLEARLY STATES "person", NOT "citizen" How clear can you get? |
[QUOTE=OverBooster,Jun 13 2008, 01:02 PM] By your rationale, using the 14th Amendment and arguing any person, it would be a violation of the constitution for anyone to take a human life in the US.
