The standard tactic is
1. file a lawsuit, while willing to settle.

2. the defendant has to
a. spend a lot of money to hire expensive lawyers to defend itself*
b. settle for a large sum (which is less than lawyers' fee above)

3. profit.

this is common plaintiff tactics.

*if the defendant wins, he really doesn't win as they have to spend the money to defend themselves and can't recoup that money through the plantiff.

That theory only works if the defendant will actually have to expend a considerable sum to defend itself. In the real world, that's not what would happen here. A case like this would be won on a motion for summary judgment with little effort, which means that the case would be dismissed. Filing an MSJ and attended a hearing may cost the defendant a whopping total of $10,000 of attorney time.
