1. file a lawsuit, while willing to settle. 2. the defendant has to a. spend a lot of money to hire expensive lawyers to defend itself* b. settle for a large sum (which is less than lawyers' fee above) 3. profit. this is common plaintiff tactics. *if the defendant wins, he really doesn't win as they have to spend the money to defend themselves and can't recoup that money through the plantiff. |
That theory only works if the defendant will actually have to expend a considerable sum to defend itself. In the real world, that's not what would happen here. A case like this would be won on a motion for summary judgment with little effort, which means that the case would be dismissed. Filing an MSJ and attended a hearing may cost the defendant a whopping total of $10,000 of attorney time.
