hi all,

45 mins ago i went to a chinese plaza for windowshop, and some a-hole hit my ass. We were both backing up out from our parking space (but 3/4 of my car was already out and her car was only 1/4 out, and she kept on moving back), and bam! She claimed that it's my fault coz she stopped while she saw me. My assumption is that she did not see me at all, coz if she did she should have used her horn.

I am sure that I checked the traffic in my back before and when I attempted to back up my car. However, when she hit me she was right at my blind spot (damn convertible top).
Anyways, my rear bumper was somewhat scratched, but not a really big deal. Her lil' old 89 Camary only had few scratched as well.

We both got out of our cars and exchanged information. She had about 4 other people with her, her bf and some of her friends who can't speak any english. She looked a little pissed, and kept on blaming it's all my fault.

My verdict is that she should not even be backing up while half my car was already out. Plus she should have used her horn before we hit each other (she did not use it so I assume that she did not even see me)

What do u guys think? my fault? or her fault?

If I were you I would try to avoid using insurance for this one. You may get a check for 500 bucks but they will increase your premium by 30% or drop you!

I claimed a mirror for 150 two years ago and my insurance company almost refused to insure the S2k. Clean record otherwise!

Exact samething happen to my friend yesterday and I was screaming at the driver who hit my friends car. Next thing I know they ran away. Good thing we got the lic plate #.

hi all,

thanks for the comments. My passenger thinks that I have no fault in the accident since we were both backing up but I was the one who backed up first out from my parking space. She should have stopped backing up when she saw my car right? She thinks it's my fault, but i think it's hers. What should i tell her to make her quite ripping me off? I really don't want her to claim my insurance.

It seems from what you say that she may have been stationary or may not when you hit each other .... I would say from the facts you have given that fault would be a 50:50 split. I would say that you both need to pay for your own damage ......

Were you 1/2 way out or 3/4 of the way out?

You didn't see her but you claim she didn't see you?

You should each pay for your own damages since you're both at fault.

Was there an accident report filed? You might need 1 for ins. if you go that route.
