Default Diamond Sponsor Refuses to Honor Guarantee

I purchased an item via GB here some time ago. The seller (who is a "Diamond Sponsor" of this site, but shall remain nameless for now) guaranteed certain things "or your money back." Well, now the seller is telling me that, although the product is not what it was represented to be, he cannot refund my money b/c his company has "money problems" and is basically bankrupt.

What is my recourse? Also, should this individual really be entitled to sport a badge saying "Diamond Sponsor"??

Mods and site admins, I am happy to take this discussion to PM if need be, or continue it here. Whatever is preferred.

Thank you.

I think you need to deal with the person you have the contract with - ie the Sponsor themselves.

Their "Diamond" is to what level they sponsor the site, not anything to do with how the site, or members rate them, their products or their services.

If his company is "basically bankrupt" as you alledge, then I'm sure he'd have trouble paying his invoices to cthree, and in that case sponsorship would be at risk.

I'm afraid your only recourse AFAIK is with the vendor themselves, not S2Ki

eagle, nice answer.......are you retarded??

if the site permits a "sponsor" to showcase their prodcuts on the site, the site has an inherent obligation to ensure that said sponsor conduct their business activities with honesty and integrity.

advertisers and sponsors are two totally different things.....

bigpurp, who is this lame-ass vendor???

That wasn't bigpurp's question. His question was "What is my recourse" My answer is that his recourse is with the vendor.

I also clarified, what Diamond meant, which is the level of sponsorship signed up to - and not a reflection of how well that sponsor conducts business. I inadvertantly used the word advertising, I edited it to read sponsorship now. cthree is the guy who deals with all the sponsors so it would be his decision about that anyway.

To answer your question. I am not retarded. Luckily I am also not offended by that comment, but keep things civil eh?

I also think you should keep comments like "lame-ass vendor" back, at least until you are able to justify that. There are always 2 sides to a story, and before drawing conclusion on who is right and wrong then I would want to understand both stories.

Often these type of things are purely a mis-communication, and if people talk can often be settled.

Aquila, I thought my initial post was pretty clear, but perhaps I should have been a little clearer: I have ALREADY spoken to the vendor (many, many times), and it has gone NOWHERE. I have exhausted ALL attempts at negotiating directly with him, and have basically been told to go pound sand. Now I want to now what the site can/will do to assist a member that has been shafted by a Diamond Sponsor who is telling me his company is bankrupt and dissolving (perhaps both literally and legally).

Plyrs, your analysis is spot on. I would think that the site owners and admins would be interested in knowing that one of their sponsors is bankrupt, and has the potential (based upon his Diamond Sponsor status) to shaft other members. If you really want to know who it is, I can PM you the info. For now, I'm holding off on calling this guy out publicly, in the hopes that he will honor his obligation. But the clock is ticking...and I don't part with $700 lightly.

maybe if you stopped being cute and told us who exactly you are having a problem with then maybe you'll get some sort of answer.

"a" sponsor is of little consequence to me. This appears to be a threat to the vendor in question for until you want to be specific I can and will do nothing. Let me know.

The vendor in question is S2kHardtop.

The intention was not to be cute, but to protect his identity in the event you wanted to handle this privately.

Thanks. Who is he? What vendor does he work for? He's not a sponsor but probably works for one.

Nevermind, he works with 4IG. I will talk to 4IG and find out what's going on with your situation. Is their a thread related to this which describes your complaint?

Hello, i would like to chime in...
brief History:
4IGS2000 was me alone 2001-2002
4IGS2000 moved onto Partnership REVTEKNIQUES

Owner 4IGS2000&S2KHardtop...2003-2003

Summary, partnership broke up after 5 months in business, basically things werent ran how i wanted it to. I left Revtekniques a few weeks ago, i took on a real job that could pay my bills, and gave the whole company to S2khardtop because i was sick of the problems(partner) that i couldnt iron out with him.

Bigpurp, i did what i could for the wing since its not a finance problem, but i would still want the old one back if you dont mind As for the bumper, the bumper is my manufacturer and my partner who are working on this.

My partner handled the finances, paid our MFGs and bills
4IGS2000 ME Brandon, handled sales and did product ordering and stocking....

to sum it up, i left REV because it wasnt paying my bills or paying at all, and plus i felt 4IGS2000 name was in jeopardy since REV was falling and i couldnt control it I plan to be back and better than ever, because we will have a ton INSTOCK, no more BS GBs, that was 4IGS2000 2 years ago

Im very sorry bigpurp to have to put you thru this situation, even though everyone only knew me, there was another person involved in REV. I would like to still be on good terms with my partner, and help him sell the rest of hte body kits and help revive the name, but without his cooporation its useless.

I do hope you can work things out, we already gave a credit balance to another customer in trade for the Js, so i hope we can work something out with you.

On a side note, our MFG gave the guarantee about fitment, now he is backing out of it he said you S2000 guys are so picky, blah blah and now he refuses to trade out the defective Js, and claims that the unfolded ones fit, and its the customers fault

Once again, from my end im a very sorry, with the new business that will form Again focused on S2000 stuff, i make it MY person guarantee you will not have issues like this at all. Since the guys who i am working with dont pull shit like this

cthree, thank YOU for looking into this. Whatever influence you can exert on Brandon or this S2KHardtop to get me a refund is GREATLY appreciated. There is no thread, since I tried to handle this with 4IG and S2KHardtop via PM.
