Yes, banning is a serious action. You need to post some (alot, actually) evidence, especially since you are going public with your charge. The admins will then take it into consideration. Conducting a poll is not the way to go in this situation. Normally, a member is warned several times prior to being banned.
EDIT - I have to add that if I were this member, I would not be happy about someone calling me out publicly without trying to resolve a problem privately first, such as reporting an offending post to the forum mod or whatever, or PMing the mod. That's just my take without knowing anything about this member.

He basically said he had a set of used tein with edfc for sale, then our member Trip paided him and and never got it, all he got was excuse for the past 3 months, of how he never got around to shipping it out. Thanks to most of our members here especially Bass he got most of his money back I believe but those 3 months of waiting then another month to get his money back must really sucks...

I might have been more sympathetic if you zealots calling for this lynch mob hadn't started this discussion with disparagement towards people like me, who just asked a simple question. How was I supposed to know that some particular thread, out of hundreds of thousands, was relevant? Am I that clairevoyant? apparently you are, because you have not given information and seem to have jumped straight from accusation to execution. And whatever happened to the injured party being the principal plaintiff? Or I suppose he has ceded you the right to speak and act on his behalf? Play with fire, you'll get burned.
