Default Being ripped off by Vancouver member -updated

Hello all,

I'm in need in advice.

I currently had an agreement with Narcissus (Robin), that I would be purchasing his supercharger. This is the link:

https://www.s2ki.com/forums/index.php?showtopic=400423

He agreed to sell it to me for $5000, but since he lives in Victoria and I live in Calgary, I was unable to pick it up immediately. I cancelled my vacation plans and rebooked to go to Vancouver instead. He insisted that I give him a deposit that we both agreed upon to be $500. I promptly sent him the money via paypal. We kept in touch over the next few weeks and he gave me his phone number, address and directions to his home.

Today he emailed me apologizing to me and saying that he had already sold his s2000 as well as the supercharger thats installed. He refunded $582.20, (the 82.20 was for any inconviences he caused).

Now here's my problem...

I was planning on doing the install at a buddies garage in Vancouver. He specifically took 2 days off and turned away customers from his shop just for this install. I'm also booked at the hotel for 5 days (21st-26th... I wanted to make sure the car is in good running shape before I make the long trek home. Dont want to throw a belt or find any leaks half way into the trip). I also had a rental car prepared for this period just incase the car had any down time and I needed to get around town some how. I no longer have any reason to go to Vancouver and I cant cancel the hotel bookings and the car rental place is closed at the moment.

I just got off the phone with Narcissus (Robin) and he is unwilling to negotiate at all. He said someone gave him an offer on his s2000 that he "just cant pass up" and so the supercharger is going to be sold to this individual. I told him that I'm still going to be charged for hotel bookings that I cant even use anymore, and says he thinks his $82.20 should be enough as compensation when my hotel bookings alone cost more than $750.

I've copied and pasted our email discussion below:

Hi,

I have bad news, I am sorry to say that the car has sold as a whole package! I have returned the 500 deposit with an additional 100 for any unforseen costs that might have arisen from this situation.

Once again I am sorry and I hope that this is fair to you

Thanks Robin

Hey,

No worries about the questions.. Yes the package comes with the 7 psi pulley and belt.. This offers much better power and acceleration gains than the stock 5 psi pulley. Also, it does not require any ecu upgrades which is nice and cost effective. Sorry it has taken me some time to get back to you I just got back from Toronto today!

My address is xxxx xxxxxxxxx St Victoria BC xxx xxx.

The Best way to get to my house is to:

1) As you get off the ferry you will automatically drive down the Pat Bay highway. Follow this for 20kms or so.. say 30 mins.

2) Look for the exit xxxxxx.

3) take this exit on your right.... as you head down the exit ramp stay to your left as you will be turning left up xxxxxx Street.

4) Turn left on xxxxx ... follow xxxxx for 10 mins until you see the large intersection of xxxxx and xxxxx

5) Turn right on to xxxxxxxxxx and merge in to the left lain.

6) Follow xxxxxxxxx for 1 minuet and look to your left as you will see xxxxxxxSt on your left. xxxxxxxx and xxxxxxxxxxxhas a set of pedestrian cross walk flashing green lights so this will help in finding this intersection.

7) Follow xxxxxxxxxxxxx2/3 the way up and you will see my house on the right xxxx!

Let me know any questions that you might have with these directions

Thanks Robin

Hey,

My phone number is 250 xxx xxxx. I am just in Toronto right now visiting my girlfriend.. so I can't rememmber which gauge line it is but they are white faced. Direction from the ferry I will provide you with for sure to help out with getting you to my house safe and sound. In vancouver it might be better to source out mapquest... the reason is that I have never lived in vancouver so I might not be able to give the best directions. But I will easily get you from the ferries to me no problem...

Gotta run but please let me know any other questions you might have

Thanks Robin

Well, it is the first $5000 that gets it! So you can have it but I will need some sort of deposit to hold it for you until you pick it up. Also, I live in Victoria BC on Vancouver island.. Will you be heading this way at all? What is the date that you are heading out here?

Please let me know

Thank you Robin

Hi,

The kit is currently on the car... the whole car is for sale so I am was waiting to see if some one would buy the whole thing... The kit will be uninstalled by Honda and that is the only place that i have my work done on the car they are the ones who installed it and the ones that and will take it out.

The only thing that you will need is a new fuel pump. The pump that comptech provides is a Walbro pump that can be bought from lordco or any major parts store for a small cost.

Are you in Victoria or Vancouver?

Thanks Robin

So now my problem stands...

This fellow sold my supercharger that was rightfully mine to begin with to someone else, and now im looking at losing a lot of money since i no longer have any reason to go to vancouver. on top of that, i cancelled my original vacation all for this SC

Well honestly, he sold the car, being in a position where he was asking 45g's or whatever for a 2001 US model car, with a wack load of parts he probably got around 40 ish considering that would be easier than never selling or having to part out he took what he thought would be correct. Heck I might of done the same thing if i were in his shoes, yet i don't know you both.

You now have a vacation to vancouver, you might as well come and enjoy whistler and the scenary and food. Hate to say it but there are flakers in the car buy sell market, dealt with it for many many years myself. It's part of the game, whether you are buying or selling.

I assume you were driving down, so just cancel the hotel and pay the penalty, and tell your buddy to unbook and ask the guy to pay a slight penalty to you for that as well.

Ranting about it with only get you other members support, but it won't fix the overall problem. I support you totally elusiv, but I wish I could do something for you but if the deal is done there is nothing to do, maybe it was a sign from above that you shouldn't get a supercharger at this time and to save your money for something else. You are at least 5g's richer if you look at it that way.

I say just ask for some compensation, then take a vacation and buy your buddy some beers. If you coming down I'll even take you out for the infamous dimsum or whatever. Since I feel bad you got screwed over at the last minute.

It's a complicated situation and before I give my opinion I'm going to edit some of what you have up there, some of that stuff should be private.

Are you sure you can't cancel the hotel(s) you booked? Every hotel I've ever booked at allows for a 100% refund if you cancel at least 48-72 hours in advance, and usually the penalty for cancelling after that is only the cost of one night's stay.

personally i dont think its completely his fault.... if i was in his position i would sell the car complete if something like this happened too.... he must feel bad.... but he cant take all the fault

you should be able to cancel the hotel... ive never heard of not being able to... i thought all u need is 24 hours

i hope everything works out for the both of u

robin is a very good guy.... i havent met with him... but i have bought a few things from him without meeting him and everything went perfect

i guess in the end im just a bit miffed that he blow off our deal without even discussing with me first.

i've done everything to make the deal go over smooth, and planned everything around his needs/wants. im curious, what if he had found a buyer for the car an hour before i arrived at his door?

why advertise a sale when not fully committed? why take a deposit when it carries no weight?

if i can cancel the hotels without penalty, then i guess i'll be a bit disgruntled. but after having cancelled my vacation and peeing my gf off, wasting all this time corresponding with him and planning the coming weeks, trying to source a fuel pump which is now useless, finding a crank puelly tool, forking out money out of my own wallet for penalties, and then getting this "i dont give two craps about your situation, here's 82 dollars and 20 cents... have a nice life!" attitude, im not going to be very happy.
