Carfax? return car back?

lets say you buy a used car. You ask the dealer if the cars been in an accident. They say "no". then they give you some sort of report.

Then you check carfax and it states its been in a accident.

You think you can return the the car back to them?

it didnt happen to me. but just curious.

i always pull carfax report regardless of what the seller says.

Depends on the dealer...typically if the car was sold under the pretense of NO accidents and you are able to prove otherwise, then yes...you should be allowed to return.

But likely, you'll have to visit the Court Room. :(

If the car has a salvage or rebuilt title I think you'd sign a notice stating that you were informed of that. In such case, you just bought some parts that together make up an automobile; you can't return it. If you didn't sign the document, then the seller is at fault. If you bought a car with a clear title that was in an accident, I don't believe you have any recourse.

Please chime in if I'm wrong here...and I suppose it could vary by state.

Does the Lemon law apply in this situation?

I agree with Raul. I'll even go further, if they knowingly and willingly told you it was NOT in an accident, and it was, you might even call that fraud.

Lemon Laws are designed to protect people who buy a new car from having the same problem repeated multiple times in the first year or so.

you have to have had pulled the carfax report prior to buying the vehicle. Then it would fall under the carfax guarantee.
