Default dealer problems

My friend took his honda into service and his intake got stolen when it was w/ the dealer. The cops think that someone working in the dealer stole it. Do you guys know if the dealer is legally responsible to get a new intake for my friend?

When I have done the warranty job in Honda, my Antenna got banned, they said it is someone who walked around the lot and did it.. but, I don't need to care about it, they order another one for me for free..!! I know, it is OEM stuff... but, yes, they are responsible for that..!!

The dealer definitely responsible for getting him a new intake. Would you mind posting which dealer it was, so we know about potential problems.
