Listen here focker. While this is not the first person to have a car sold out from under them it is a reflection of Sales in general wether your selling cars or toasters.

Anyway. If he has paperwork I don't see how it wouldn't hold up.

Title.

If he hasn't signed the title then it is tough game for him.
If the dealership sold the car even after the title has been signed then they basically sold the car to someone which isn't theirs.

So TITLE is the issue in this case.

I am dependent on car dealers for my job. We work with 3000+ of them across the midwest, the southest and Arizona. There are good ones and there are bad ones. If there is one thing I have learned, it is that a lot of what people believe about the business is true. More often than not, negative stereotypes about the business are proven over and over. In the business of selling cars (and in my case of financing cars) survival is foremost in the minds of everyone. That means that some businesses out there will pull this kind of crap to make an extra dollar.

I will amend my prior statement to say that some dealers will not resort to tactics that generate poor reputations. Yours is one of those. Clearly Metro Toyota is not.

Now go tell your F&I guy to send me some business.

That's not completely true. The title determines nothing but current ownership. A bill of sale with deposit is a contract for the stated allotment of time necessary to complete the transaction.

Yep. Downpayment is consideration to fulfill the sale. The seller is liable for damages.

he should call Cleveland police and file a theft report.

Unless this dealership ripped him off and took his money without giving him the car then there is no case. This happens all the time and it is unfortunate but to say there is something criminal here is streching it. Lesson learned is the moto here.
