most of these opinions are inaccurate. It is not ILLEGAL to change the terms of a deposit and sell the car to someone else unless the seller does not return the deposit. there is no violation of criminal statutes and therefore is not illegal. The OP does have a cause of action for breach of contract and potentially fraud etc. Once the seller made an offer and the OP put a deposit down there is a legally binding contract which terms can not be changed unless agreed upon by both parties or it becomes impossible for the parties to complete the transaction (death/car stolen etc). the seller breached that contract by changing the terms and saying he is going to sell it to someone else. The op can sue to get an injunction to prevent the seller from selling the car but that would be costly and probably time prohibitive. the OP could sue later on for damages. In order to show damages the OP would have to prove that he couldn't find a like car with same modifications/mileage for the same price. With that said there is probably an arbitration clause that precludes legal action but does give the OP a lower cost alternative to starting action against the seller. If I were the OP I would threaten legal suit, but more importantly file a complaint with the governing body that regulates the auto sales industry in the area. Also find avenues such as BBB and leave negative feedback on search engines such as yahoo and make sure you let the dealership know you are doing so.
