Cracked bracket on header

Cracked bracket on header
We just got a Mugen header. The bracket that is halfway down that mounts to the bracket that attaches to the engine/tranny has a crack through it. A picture of Mugen and stock are below. I've now see that this appears to be a common breakage point. I'm assuming because it is stainless, which is more brittle than the stock steel. It seems some people run without it attached. That means all the bouncing and torque goes to the mounting point of the header to the head, and possibly through the joints in the pipes themselves.
I'm thinking of making a band clamp with steel mount on it so that it won't be so brittle. I also note that the Mugen bracket is on only one of the two pipes, whereas the factory stock one has a band welded across both pipes. I'm thinking I might want to do something like that here too. Otherwise the other pipe still can be doing all the flexing - which might also contribute to the bracket cracking.
Is anyone certain that just running without that bracket attached does not put too much stress on the head/header mount?
I also have not made the swap yet. So I'm not quite sure yet why in the pictures the stock versus Mugen brackets appear to be in completely different locations.
