in short VW gamed the emissions test to pass with better results than during normal operation.
when you plug an emissions tester into the OBDII port it would "clean up" the emissions profile.
VW has admitted to this and needless to say the EPA and CARB are more than a little miffed.
Look for VW to be using those special wide checks that have lots of room for numbers.

A radio show I listen to was talking about this weekend and they said it could amount to 37,500 per car. We are talking BILLIONS!

Not only will VW have to come up with a fix for the problem..... and pay for it...
The fines they are talking about are staggering.....
And most likely the "fix" put into place will lower the mpg..... so VW will have to shell out some $$$ for all owners of the cars fixed!
Lost sales due to it.... people not trusting VW going forward.....
Going to be interesting to see how low their stock will go over this!

This pales in comparison to the GM cover up on faulty ignitions. 125 people killed, many injured over 10 YEARS!!!, and a paltry fine to GM. Will never buy a GM vehicle again.

I would bet at this point a lot of manufacturers are worried.
To date there has been a trust relationship that the OBDII port was telling the truth.
Knowing how the govt tends to react to these sorts of things, it just cost the industry a bunch of money in additional testing.
They will have to run two tests now, one with and one without instrumentation to validate the OBDII port data.
I'm also curious about how much performance/MPG improvement VW got.
It had to be a lot to make the deception worthwhile, which means it is all the worse for them to deal with.
