Bought a car privately that broke down after 10 miles, where do I stand?
 
Hello all.

The other night I bought a new car from a private seller. I made the way up North for the car and on the surface everything seemed great. The test drive was good and I was overall happy with the car. The seller seemed genuine and we agreed on a price, and I was on my way home with the car.

Until about 10 miles into the journey when the engine started to make an awful knocking noise.

I immediately called the seller who came to meet me and inspect the car. He inspected the car and stated that he was not sure what was making the noise, but refused to take the car back and refund me, stating that he had not had a problem with the car and claimed I had either abused it and caused the failure or that I was extremely unlucky and that it was my car now.

I can't help but feel that something was dodgy with the car and I've bought a lemon, but legally where do I stand?

Ah, well. That didn't take long.

I am in fact the seller in this story, but I was interested to get the opinion of those who thought I was the buyer.

It may seem harsh, but that's bad luck for you unfortunately and the way it is with a private sale. I've bought all of my cars private knowing well that if anything goes pop as soon as I leave once cash is handed over and documents signed that it's my problem. If this type of thinking concerns you, then buy from a dealer in future.

You need to forget about the seller and start thinking about the most economic way to repair the car.

Just skimmed through the first page on PH. Unfortunate for the guy that bought it if it has just given up on him, but as pointed out on there he could have over-revved it or missed a gear etc.
