Hamiltons escape speeding penalty
From today's Daily Telegraph:
[I]Neil and Christine Hamilton have claimed a "victory for the downtrodden motorist" after escaping a fine for speeding.
The disgraced former Conservative minister and his wife were in Mrs Hamilton's car when it was registered at 63mph in a 50mph zone on the M62 near Rochdale, in February.
Mrs Hamilton received a fixed penalty notice months later but claimed she could not remember whether she or her husband was driving at the time.
The case was thrown out yesterday by a district judge at Manchester City Magistrates Court. Mr Hamilton said: "For once, justice has been done in an English court, which has not invariably been the case in my experience.

It's actually quite an old trick, but it doesn't always work...
A friend of a friend was sent a NIP from a (front facing) motorway camera, reporting that he had been speeding. He challenged the points on the basis of not knowing who was driving, with a view to not getting points on his license.
Unfortunately, the kind police sent him a photo, from the camera, of what was clearly the friend, driving the car, with one finger wedged securely up his nose. He quietly paid the fine...

But surely if you didn't name the driver they simply did you for witholding it - thats what happened to a colleague.

Someone once told me that if you claim not to know who was driving then (unless the car was reported stolen at the time) they will prosecute the registered keeper of the vehicle. I guess whoever told me this was talking out of their arse.
