Certainly in English law - it hss been a long time since I had cause to look at this, but I have a dim and distant memory from university of it being known as the rule in Rylands -v- Fletcher. However, since you have a different system of law north of the border, I have no idea whether there is something analogous.

Let's hope the neighbour does the decent thing and coughs up without causing any problems.

Noisy buggers as well

I used to live next to a farm, one night the cows escaped and one of them leant on my pristine Mk2 16v Golf and put a huge dent in the wing. The farmers insurance paid up, no problem. All farmers should have public liability insurance, if it's a private owner you will probably find that they would rather pay than get taken to court.
