That only goes to prove that insurers not only shaft you with criminaly expensive premiums but all they want to do is make a furthur profit from selling on your repairable car, there is a legal term for that.........THEFT.

Get some more independant quotes and report them to the insurence ombudsman.

if they pay out as a total loss, am I right in saying they take legal ownership of the car and so can sell to whom they wish for what they wish?

I don't see the issue if they payout? I'm not defending insurers here, but simply stating what I believe to be the case, they can do as they wish once they have met their obligations to you, ie paying out as a total loss.

Until they pay me out the car is still mine though?

They cannot sell it till I get my pay out surley? Then I will register my interest in buying her back,

Admiral rang this morning but I need my V5 and MOT certificate, So now spending more money to get home then back to girlfriends, Ment to be at college today and Tuesday, that's out,

Oh the fun,

Should I be looking at £13-£14k looking at the prices of 08 cars? Or am I well over my head?

Thankfully get paid Friday so all this overtime can get me a runabout while the S gets fixed If all goes to plan :s

They've taken a few hundred (probably) in premium and will pay out several thousand settling the claim. That's not a profit, selling on the shell will reduce their loss somewhat.

Some contract law probably applies here, nothing whatsoever to do with theft.

theres a few in the trader with low miles for 13+ and insurers normally pay out over the odds anyway sometimes after a bit of of bother on phone calls but i dont see you getting lower then 13500

I'm with Admiral and they have been pretty good to be fair. Tell them as soon as you can that if they wish to settle with the car being a write off then you wish to negotiate a deal where the car will be included in the settlement deal.

I just worked it out properly and I paid 13% of the car's overall value that Admiral put on it with their settlement payout. I'll PM you with my number in case you want any help and a proper chat about it all.

Logically if the value to fix the car is £9218, and lets assume the payout for the car is £13000, then from the insurance point of view the damaged car has got to be worth at least (13000 - 9218 = £3782) Otherwise it would be cheaper for the insurance company to fix your car than write it off.

The insurance company will always want to go the cheapest route. However there may be some "value" placed on their administration, which is probably higher in the case of repairing the car.

However I would have thought an '08 plate damage repairable was worth at least £4k. Even as a parts donor, a low mileage engine and gearbox will be sold by a breaker for £2k to £3k. S2000 are now being used as a donor vehicle for kit car builds. Even Westfield do a S2000 based car which looks great!

Where is the car now?

if it is with a bodyshop/ storage yard. get it moved to either your house or if you want to have it brought to the bodyshop (that floppy said about) thats fine. if they pay out while a storage yard has the car its difficult to get it back as they usualy have a contract that says they can keep the car.

I am sure they said its going to a storage yard now but i said i want to buy the car back,

I have a friend dealing with everything now as am at work so cannot just run off and be on the phone for hours while they mess me about trying to give a low payout,

I need to find out if its worth repairing or just strip it,

Would of happily bought all Floppys parts but now there diffrent i need to look into the best way to sort it if she is to go back on the road, I can get most off Floppy but the most expesive parts would be the ones that are diffrent ehh,

Just waiting to find out what i can expect,

I rang them yesterday (no phone call back ehh) gave them V5,MOT and Confrence call to prove licence then just told them to deal with a friend from now on,

And he has not rung me so am guessing no phone call to him either at the moment,

Just a waiting game now

Chase them. They're not amazing at getting back to you. I'd definitely get the car moved from storage.
