Default TOTAL BS!

Last night I had a few more drinks than I was planning on. I figured I would just sleep it off in the car (parked off Mill Ave) and drive home in the morning. I heard that you could get a DUI for even being in the driver's seat at all drunk so I slept in the passenger's seat. About 2am I woke up to a cop banging on my window with a flashlight. I get the usual 20 questions, what are you doing here, blah blah blah. He asks why the key is in the ignition. I was listening to the radio, which requires the key. Well it turns out that I am considered to be operating the vehicle because the key is in the ignition and I am the only occupant, even though the engine has not be run for like eight hours and there was even a parking ticket on the windshield stating the car was parked exactly there four hours earlier. Long story short, I blew a .12 BAC and now I'm being charged with a DUI.

If the charge sticks I'm totally screwed. Any ideas on what I should do?

i call april fools... just becuase This happened to me. theyc op was more happy the fact that I didnt not drive..

Was in Tempe PD or someone from my Dept. at ASU PD? If this is real that is, your done. The law does state that if you are in the car with the keys in reach, that you are in control of your vehicle. Next time throw the keys somewhere far away, or just be smart and call a friend.

Just do the same thing JD did when it happened to him while he was pushing his scooter home.

Also I would suggest you watch less Scrubs. I think NBC frowns on plagarism of their material.
