Default Anyone up for giving some leagle advice?

Hi,

I'm a member on another board/forum/association which has wound up in trouble.

One of the members is threatening to sue the association because of supposed
deformation of character on the forum.

It appears that this particular member has broken the rules of the forum in
some of his posts and could be banned for his efforts. He started a posting
war and didn't like losing.

This is where the fun starts.

The Queensland branch of this association is not incorporated so the individual
committee members will be liable.

Basically if this guy pursues his case it will be the end of the association as they
don't have the funds to defend this kind of stupidity. He has sent them a
letter stating his case and threatening leagle action.

Does the association need to make a leagle written reply to this letter?

The Committee members in the Southern states are all for kicking him out.
Of course they are incorporated so there is no issue for them.

I'm all for two taps in the back of the head in a wetland somewhere!

Really?

The legal advice is, yes they can be sued.

The practical advice is, unless there is some massive financial loss being suffered by this goose because of the deformation (sic), he'd never bother. Just starting a case would cost him at least $5k, and probably more.

Tell your buds to remove the offending posts, terminate his membership, and move on.

Defamation is when verbal or written, untrue staments are made, and as direct result of that, the persons reputation or financial state is injured. Calling him names and such its hardly defamation. (if thats the case) Even if this guys a forum trader, his got pretty thin cause,let alone a case. As stated above delete the threads, ban him and forget about it. If its not written anywhere its not defamation. Also, stating an honest opinion of someone isnt defamation.
