CARB Sticker Question

Default CARB Sticker Question

So I was at the vista point off 35 last night with 10-15 other cars. When we got rolled on by the police. Long story short they made everyone pop their hoods. (you have to they dont need a reason/warrent) My only engine mod is a AEM V1 CAI. BUT. I dont have a CARB sticker for it so the cop didn't give a crap. So I was about 15 seconds away from having to foot it home when the cop realized my buddy is the guy who serves him coffee every morning at starbucks. So he let me go THIS TIME. So the question is: If I know the CARB # (E.O.#D-392-18) and i have the install manual with the # on it will that make the cut next time? Is there a way I can get a replacement sticker from AEM? Is their anyone who wants to make a copy of their sticker? Can someone help me out here?

even if it's 50 state legal, you need a carb sticker?

technically you can refuse to pop your hood actually, they might just give you attitude.

No because it a law...

California Vehicle code allows CHP and other law enforcement to inspect your vehicle if they believe a violation of code exists.

2804. A member of the California Highway Patrol upon reasonable
belief that any vehicle is being operated in violation of any
provisions of this code or is in such unsafe condition as to endanger
any person, may require the driver of the vehicle to stop and submit
to an inspection of the vehicle, and its equipment, license plates,
and registration card.

2806. Any regularly employed and salaried police officer or deputy
sheriff, or any reserve police officer or reserve deputy sheriff
listed in Section 830.6 of the Penal Code, having reasonable cause to
believe that any vehicle or combination of vehicles is not equipped
as required by this code or is in any unsafe condition as to endanger
any person, may require the driver to stop and submit the vehicle or
combination of vehicles to an inspection and those tests as may be
appropriate to determine the safety to persons and compliance with
the code.

So if they ask you have to do or you can just get put in cuffs and then they will do it themselves. Whats sad is that police of course single out and profile specific cars

I was told that unless I could prove it was legal then he would assume that it wasnt because he couldnt know for sure and I couldnt prove it. So you would have to go to court and prove that its legal....alot of bs work for a small mod that is legal

The term "probable cause" is so vague, but don't let police officers use that term anytime they want to.

If you were pulled over for street racing, than THAT is probable cause to get a hood popped.

But like one of my situation, I got pulled over for rolling on a stop sign very slowly at like 1am, and he asked to pop my hood. In my opinion, that is NOT probable cause. Just because I rolled on a stop sign on an empty road, doesn't intend at all that I have illegal modifications.

I Don't know if you were doing anything stupid, but in your situation, rolling with 15 imports is not probable cause to get hoods popped. Even if all 15 cars looked like straightup hot rods, the police officer shouldn't be able to use probable cause to pop your hoods. Answer this, can a police officer randomly pat down 15 guys wearing "I love marijuana shirts" if they were all caught in a smoke shop looking at pipes? No, the law doesn't allow the police officer to do that, because technically there is probable cause.

You should always cooperate with police officers, but dont be afraid to exercise your right to say no if you believe they are abusing their powers.
