do not order any spoonsports parts from here.
they say theyare an authorized dealer yet cant get a simple order for me.
i ordered my spoon clutch and flywheel in the 1st week of feb.
they said 3 to 5 weeks right?
well i called during that time and they said call back in the 2nd week of march. so i did. now they said call back int he second week of april. so i called today and asked you think youll get em by next week? and the guy answered, honestly no. becuase we didnt get no fax confimation. now my car sits in my garage and i cant go nowhere. not even to school. which is only 5 miles away.
worst of all, they said i cant get a refund because i signed a non-refundable special order deposit.
i need your guys' opinion. do you think i have the right to get my moey refunded if tthey dont receive the order in the 3 to 5 weeks that they say they can? should i take legal action?

sure you can - their side of the contract has not been initiated - if what they say is true (no confirmation)
They're not going to lose anything if they do not order anything and give you back your money
You say there is a breach of contract and that you are suffering damages because you are not able to make it to school sometimes - from not being able to find a ride "everyday" -
and tell them that if they do not give back money - they will suffer from loses not only from court fees, but also from compensatory damages from the difference in (higher) price if you go elsewhere and purchase it there. You have made a resonable attempt to mitigate damages. (make sure it's fair though)

A similar issue was discussed in another thread. Some say there is a such thing as a non-refundable deposit (in most states at least).
Anyways, you should easily be able to get your money back.
