Settling or losing this case would open the floodgates for idiots who blame everything and anything on their cars. They DO NOT want this person to win. Hell, all car companies that have keyless go will help Toyota fight it, because if toyota wins, everyone is in the clear...if toyota loses, everyone gets sued the next day.
As for leaving the engine on...on my dad's 2010 RL, if you get out of the car with the engine running, and you close the door, the car will emit a LOUD series of beeps. There is no way, unless you are deaf (in which case you can't drive) that you don't know your engine is running. I am certain Lexus has the same feature.
