Bourdais has only scored six points from the 27 grands prix for Toro Roso.

But he said: "I consider that Toro Rosso has breached contractual duties. Nothing in my behaviour would legitimise a decision to terminate.

"I have instructed my lawyers to review the situation including the possibility of issuing legal proceedings."

Bourdais' place in the Hungarian Grand Prix on 26 July is expected to go to Spain's Jaime Alguersuari, who, at 19, would become the youngest ever Formula One driver.

He may well be in denial, but that doesn't preclude him having a decent claim for breach of contract unless the contract gives TR the right to terminate early.

It's like football where managers are sacked - it almost invariably requires the remainder of the contract to be paid off, even if the manager has just steered the club to relegation.

Indeed. He's just the latest in the line of "successful in America" drivers who's failed to make an impact in F1. Remember how embaressingly bad Zinardi was for Williams when he made his big F1 comeback? (Which is what gave Button his break IIRC).
