Default Dodgy whiplash claim

Some of you may remember that just before Christmas, my wife found herself in a box junction and slowly reversed backwards and into the front of an 02 plate BMW.

The impact was less than 5mph and the damage to both cars was very minor although the BMW driver got a new bumper and spray job at a Bimmer main dealer (£800)

The civic my missus was driving had (and still has for that matter) a small scuff.

Our insurance settled his claim, we didn't bother claiming for the damage to our car as it was pretty much bugger all.

Well today we get a letter from a firm of ambulance chaser saying they have sent a claim into our insurers for a personal injury claim.

"The claimant suffered neck and right shoulder pain the day after the accident. The pain lasted approximately 8 weeks. The claimant self medicated with Ibuprofen."

My kids were in the car, never mentioned it when I got home. Both of them straight back into video games and arguing with each other as normal.

Firstly, the "accident" was at less than walking pace. Secondly, the guys lists his profession as an ENT Surgeon! Like he needs a few grand from a dodgy insurance scam!!!

I'm almost tempted to lay out some personal cash to fight this. If it costs me a few grand to stop him getting any it'd be worth it!

Your advice please oh wise ones. And may it range from the expected "First, shit in a bag..." through to proper legal advice.

Yours hugely peeved.

Check your policy, you may have legal cover included.

Use that to fight it.

Would be good to see someone who is extracting the urine get taken to court and having this turned over.

Don't waste yer f cuking time; the legal expenses ponces will merely run up their own bill & then fold before court: it's all a game to them.

Forget it. Or gain a private ENT consultation & take a dive in his office!

How are you going to prove he didn't sustain an injury ? (even if he probably didn't)

Are you a medical expert ?

Forget about it, retribution can be sought in other ways

1. You are not paying for it

2. Are you sure its genuine? Why would they contact you direct and not your insurance first? Sounds iffy to me.

3. Was the original claim settled in the knowledge it was a 5mph prang - if so no effing way they will pay that anyhow.

Let the insurers deal with it. They are far more experienced at dealing with this sort of thing than you are.

If it bothers you, ring your insurers and tell them that you think this is a fraudulent claim and give your reasoning.

But after that, let your insurers deal with it.

i thought that if a person has been injured in an accident it has to be reported to the police.


otherwise it doesnt mean anything.

SC - I don't think that counts for the ambulance chaser type "follow-on" injuries.

The Police only want to know about RTAs if a road is blocked, a vehicle / pedestrian somewhere dangerous, or someone is injured (and requires medical attention) at the scene.

...at least that's what I was told when I was hit by a lorry on the A43...

i was told by an ambulance chasing company to report it to the old bill when i claimed ages ago.

was a cut and dry case as she reversed straight out in front of me.

i was younger and broker then
