Default How long should it be.......

Just read this horror story in the local rag.

I can't believe the paltry sentencing for such stupid actions which have caused the loss of someone’s daughter forever. The punishment for this law surely needs to be changed. As for a 5 year driving ban, is that really going to stop a complete **** like this guy from getting behind the wheel? What kind of punishment is it when the ban and sentence run side by side? Surely they should run one after the other?

Then again, what the average time served for manslaughter? Something daft like 5 years!? This Countries Crime and Punishment system needs a major boot up the arse. Maybe we should start executing more of the pond life like this scum.

yep

the max penalty for that offence is ten years iirc

I've never seen anyone get that and wonder just what you would have to do to get that

live in a nice house and have a great career I suspect...

Why should causing death by dangerous driving carry a harsher penalty than just dangerous driving? If his passenger had happened to survive, would his penalty be much less?

I’m not fully up to date on sentencing guidelines, but I think it would go something like this.
10 years as a starting point.
one third off for pleading guilty.
Another lump off for showing remorse.
That gets it down to to four years and eight months in prison.

I’ve read that part of the idea of allowing the one third off for pleading guilty is to move cases through the courts quicker.

TBH, it doesn't really matter what the sentence is.

Doing the time is a piece of piss compared to remaining alive with that on one's conscience.

I think I’ve mentioned this before, but in cases like this I’m always curious about what the passenger was doing in the time leading up to the crash.
Was she cheering him on or begging him to stop?
Was she aware he was drunk and stoned, or was she too drunk and stoned herself to notice or care?

I tend to be a lot more sympathetic to the poor pedestrians caught up in these situations than with the passengers of the cars.
While it’s tragic for the passengers to die they did make the choice of getting into the car with such a driver.
