Default TICKET: 72 in a 70 !!!!!

While riding with a client to Raleigh on I40 this week my client was talking about how his 540 speedometer reads about 3mph faster than the car is really going. I commented that my 740 was the same and noticed his speedometer read 75mph. Up ahead we saw a state trooper going slightly slower than us. My client commented that mabye he should slow down and not pass the trooper. He also commented that he didn't believe the trooper would pull him and chose not to reduce his speed. We inched closer to the trooper's car and overtook him ever-so-slowly. As soon as we got a full car length ahead, the trooper pulled in behind us and flashed us.

The trooper asked my client for his license and registration, then asked his phone number and age (seemed a little strange). He asked why we were traveling so fast and my client responded "I didn't know I was speeding." The trooper then told him he was going to write him a ticket for exceeding the posted speed limit.

While it is true that he was speeding and he knew it, ticketing for going 2 mph faster than the limit seems rediculous. I'm sure my client can get it dismissed but it will not be without cost.

Another lesson learned, I guess.

yeah, as a general rule I don't pass troopers unless it is apparent that they are going under the speed limit.

Man, proof that cops can be pure asses at times. Best thing is not to pass (obviously, this is clear now).

It was obviously more of a "power" stop than an actual concern for public safety. Glad it was not you who got the ticket.

What was your clients car? I'm assuming a 740, but I'm unsure.

A 540. The worst thing about this whole thing was that the trooper was effiminate. If you're gonna bully someone with a power play, at least have a stiff wrist about it!

The bottom line is that speeding is speeding. If the cops and judges would convict everyone that was doing only 1 or 2 mph over the limit most of us would not push the 10-15 mph cushion we're accustomed to. But I do agree, 2 mph over is just a waste of everyones time. For me, I never pass a cop, period.

Well atleast you didn't do a 108 on a 65 my court appearence is this coming monday!!

Dude,

I would try this approach. Call your BMW dealer and request BMW's acceptable limits of %error for their vehicle speedometers (calibration). Try and obtain a hard copy. Note, Honda has a +/-10% rule at any given speed. Yes, I have the TSB that shows this limit in writing. I suggest he present this to the DA or Assistant DA. In most cases, he may get off with an improper equipment violation.

What an A$$. Nothing better to do. I would not be suprised if they tried to charge you with "Terriorism" at the High Rate of speed he was traveling. +2MPH is BS. Heck, the wind could have blown him 2MPH over the speed limit.

I got pulled once when I passed a trooper when my speed was 50 in a 55 zone.It had been raining and I eased by the trooper who was probably going 45. He blew me out for driving to fast for conditions and let me go with no ticket. It was clear he was having a bad day and wanted someone else to share in his misery. Notice I said it had been raining. I followed him while it was raining hard because I felt passing would be unsafe. I waited until the rain had slacked off to go around him. Also ,this took place on a four lane divided highway with virtually no other traffic. What a total jerk!!!!
