So what about states that don't let you 'lock' the gas pump on. (I.e. the little tab that holds the gas flow in the 'on' position.) Hawaii for one does not allow these 'locks'.
I usually just wedge the gas cap under the lever.

Some gas stations don't have the lock you refer too, others do.
