Hey here's a question....
If all the spots in a parking lot are taken and there's nothing at all on the road or anywhere around... should you be able to park in a handicap spot? After all... there's NO spots at all and either you go home and the store doesn't get your business, hoping a handicapped person comes along... or you take the spot, do business and then leave.
Okay, same scenario but what if there's more one open handicapped spot?
