You 100% sure about that? I'm pretty sure that there are some opportunistic laywers out there that will be able to add the owner into a lawsuit as well... Unrealistic perhaps, but think about the guy that breaks into a house, somehow breaks his leg and sues the homeowner and wins...

I'm noting that a civil lawsuit would be very easy to win in this case, since you'd basically be suing for negligence. Lower standards to win this than a criminal case.
