I'd fight the crap out of that ticket, issuing officer did not witness the alleged incident, comes down to hear say, which any judge should dismiss immediately.

Fight it, they have no case, unless the off duty cop shows up as a witness.

If the cop did not witness it he cant cite you for it. At that point its his word against yours. And that will not hold up in court. All you need to do is tell the public defender you want him to pull the video of you commiting this act. Once they see its a he said she said case they will more than likely drop it.

yeah i'm going to try and fight it. I don't think that they can do anything because the officer that pulled me over did not witness anything. The citation came from the off duty officer though. So i don't know how that'll work out. Anyways thanks everyone for the comments. If anything I will probably get a lawyer to help me fight this since I rather give a lawyer my money than the stupid police station that is trying to screw me over.

If the citation came from the off duty officer than it will be a bit harder to fight, as an off duty officer can still issue them, but it is still worth talking to a lawyer about, even if you just show up in court yourself and say 'the dude pulled out in front of me and i had to take defensive and evasive actions to avoid an accident' its still better than nothing.

Let the lawyer speak for you. While fighting the ticket on your own is a valiant choice, the lawyer should be the better choice. It will cost a little bit, but points cost a lot.

How can the citation come from an off duty cop ?? Thats absurd. He cant pull you over as far as i know. The officer who did pull you over is the only one who can issue the citation. I see what their trying to do here but that seems outside the realm of legal. Basically the off duty knowing he cant pull you over has a buddy do it. But since he didnt see it the off duty wrote the citation... their trying to make it as confusing as possible so the court doesnt realize that. But thats the issue you need to address to the defender. Plus you can fight it by saying if he wasnt on the clock how did he write a ticket ?? And if he wasnt working how legit actually is the citation ??
