Default Bicycle Accident

Well without getting into to much detail I was riding my bicycle and was hit by a person who was backing out of a driveway. I don't remember to much about it but they air lifted me to the trauma center were they performed all the scans and x-rays, and was released the same day. The driver was ticketed for an illegal back-up and has insurance. Just wondering if there were other folks out there with a similar experience or can give me some advice on what to do next. This happened Thursday and I hope to be back at work on Monday. I am going to see if my bike can be fixed and will now wear a helmet. I was just lucky and ride in the same place everyday: a brick walled subdivision but it only takes one time. Here a pic of the face plant.

ouch! all the worst ones seem to be right infront of ur house... we had a guy break off of a group ride right next to his house, put a tire into the drainage ditch right in front of his driveway and now has a titanium forehead.

i wish i knew what to tell u legally, other than a bicycle has all the rame rights on the road as a car does, so their insurance should have to pay for ur medical bills and bike repair/replacement.

always wear ur helmet! as many concussions as ive had id probably be dead if i didn't... in fact i have one helmet on my wall thats split into 2

Advice only because you asked, keep an eye out for reverse lights, things happen very fast as you already know The driver may have (and most likely did) looked behind and seen it was all clear started backing up...... and here comes you and in an instance your eating pavement Not saying this is your fault or the other guys but, we must all take reasonability for our own.

Just to add a little info, the person parked illegally in the drive way because they blocked the sidewalk. They had to because there was already a car in the driveway so the rear of the car was almost on the street. They maybe backed up about a foot and got me as I road by. They got the ticket and it was clearly their fault. Just need some legal advice. I road this same area for almost a year and do the same lap 16 times a day and always look out for this but there was little movement of the car and I could not see this coming, I had the right of way.

get in touch with a real lawyer... Not many of us are qualified to give legal advice.

I hope you recover soon, looks like you got the worst of it. I certainly would think that you have the same rights as another car, you should be able to have this person pay for medical bills and bike repairs/ new bike.

1800 ask gary....

Seriously inquire in the county you live in who's the best trial liability atty and consult him. Cheap on the front end, and if you do need additional legal help you've laid a good foundation.

If you're ok and you and the guy can work it out, we're all better off but if you can't, cover your butt.

That looks really sore.

I hate to do this but, I'm having a hard time with this thread. If I am out of line I apology and, please delete my post and accept my apology. I was not there and am only basing my opinion on what has already been posted. This is how I would act and handle this unfortunate situation.

You seem like a pretty smart guy (this is not sarcasm) and probably have the answer to your question already. You are just looking for absolution so you can move forward with suing this guy and feel good about doing it.
The more you describe what happened the more I lean toward this being your fault.

Puddy my advice would have been the same to the owner of the car.

In today's world, you have to cover your ass.

It's sad that's the way it has to be, but necessary. When it comes to atty's, never skimp, always use the best one in their field in your jurisdiction and then listen to them.

And don't call Gary.
