The problem with calling your insurance company is that when you file a claim with them your rates go up, and you have to pay your deductible. When it is clear that the accident is someone else's fault, and you claim with their insurance company you pay no deductible and your rates won't go up.

IMHO it's downright stupid to call in a claim with your insurance company when someone else did the damage. Call their company and let them pay for the repairs. The Insurance company isn't repairing your car anyway, the shop you choose is.

The ball is rolling. I called my insurance company and asked them what I needed to do and what to expect. They told me exactly what you guys just said. Called Geico and started the ball rolling. Also told them that I wanted to file for depreciated value as well.

Aww, that sucks James! However, I'm really impressed that the person who hit you stayed around and got the cops. I've been hit in the parking lot before with no one around to own up to it.

with making sure the alignment is right! Apparently my front fender is out of alignment and I never even noticed it. I have no idea how and now I'm stuck trying to figure out what to do about it.

Call the other person's insurance company. That way you don't have to lay out any deductable and wait for reimbursement after the two insurance companies work out the details of the subrogation of the claim. Just my two cents for what it's worth. My wife has been in two accidents with her Pilots, one totalled, the second merely damaged. I worked our both claims this way, and never had to pay a dime. Of course, whenever I identify myself as a lawyer, the level of service always improves...I guess they just don't want to deal with me.

Thanks guys. Any advice on where to have it fixed? If I go to one of their places the work is guaranteed. If not it isn't. Any ideas of what the actual repairs will be?

my USAA, my Friend.... glad your ok.. and i'm sure it'll all get fixed... thought it is nice everyone was already there so you didn't have to get all that geared up... they did... that's a good person and or the cops were right there and he was looking like... yea... I just did that... hi... anyway.. USAA will get your money outta his insurance... that's what you pay them for...

i never laid out a deductable... USAA guy showed up cut me a check and end of story... no haggle no debate and on one where it did have missed items the auto shop found no discussion...
