Quick question about being pulled over

Default Quick question about being pulled over

I was pulled over the other day and after it was all said and done the officer told me "don't even try to fight this I have the whole thing on tape and that's exactly what the magistrate will see if you do fight it". I'm not going to go through the whole story but I've been pulled over my fair share of times and deserved many of them but this one I believe I didn't deserve.

I was wondering if it is possible to view, or even get a copy of this tape. At least this way I know what I'm going up against.

There was also someone on here, tried searching, but to no avail I could not find him. What I remember was him claiming he was pulled over several times and after going to court he never recieved a ticket. I just want to get a hold of him.
I think it was zacksdad or s2kpuddydaddy but I'm not positive.

Dont they have to inform you if they are recording the stop? Audio anyways?

I don't have any idea whether they need to inform you that they're recording, but although i'm not a lawyer i did stay in a Holiday Inn last night, and I do believe you have the right to file a discovery motion, which basically requires the prosecution to give you access to any and all evidence that they will present in court. As to how you'd go about this, i have no idea.

jca is correct, the prosecution, and defense is not allowed any surprises. all evidence must be made available

if you think you were ticketed unjustly (or not) I would still get representation and go to court on all tickets. Video or not, you would still be better in court than just paying it.

Talk with puddydad (Ben) he has experience going to court. Spoonsports2k's fiance (corrie) is a paralegal at a law firm that deals with this kind of stuff, so maybe she can get you some help too.

Well that means that if I go around the courthouse/ clerk of courts and ask enough people I will finally get the correct answer on where I can get a copy of the tape.

I was given the tickets in Naples so I doubt spoonsports fiance would be willing to come the whole way down and help me in a district she's not accustomed to. I will give puddydaddy a ring and maybe he can get me started on the right foot.

Man it really sucks that even though I know I'm totally innocent I'm questioning taking it to court because of all the negative things I've heard from others and dealt with myself. I've been in court before and had the judge tell me that "this officer has been in my court multiple times so (I believe him more)" I was just thinking so if I come to your court the same amount of times you'll believe me hands down over someone else?

Define pulled over>

what is the Cliff Notes version of what happened??? If you dont mind me asking.

mitigating circumstances being taken into account, if you were "speeding" then you were "speeding" - not flaming you but an explanation of your innocence or the events would go far in shaping our advice to you.

Only way to beat him is to become a multiple offender??? What has this economy made the USA into?
