Honda Negligence? Help!

Default Honda Negligence? Help!

Three days ago I was driving home my S2K when another driver cut me off on the freeway. I slammed on the brakes and my car lost complete control. I did 360's down the road, smashed into the curb multiple times, had rocks sand blast my paint and even got hit in the face with a bunch of stones. To top it off, I narrowly spun around an oncoming light pole which would have sawed the car in half, most likely killing me.

Luckily, my friend, who was following me, witnessed the accident and was able to vouch to my insurance company I wasn't making up the cut-off part. Up to this point, I feel like, I'll pay the deductible and insurance will chalk it up as not my fault.

Well, today I took my car to the Honda body shop for the appraisal. When they lifted up my car they found the spring stiffners still attached to my springs!!!!! I have over 6K miles on my car at this point. The tech got really scared and popped the stiffners off quickly.

Now I am left wondering, what am I supposed to do? I think my insurance company, whose adjuster witnessed the spectacle, is going to sue my dealership. I am thinking I should do the same. I almost died, had to walk to the dealer, am having to walk to work, and won't have a car for a month. Furthermore, the pre-delivery checklist stated, spring spracers removed. Lastly, the tag from the spacers was in my trunk and it clearly stated, "do not drive with these installed above X number of miles per hour (I think 10) as it will cause suspension damage and unsafe road conditions."

What do you all think? I don't want to drive my car if the suspension is compromised and I think driving in unsafe conditions for 6K miles, including a life threatening accident requires some form of compensation.

I would raise hell. Clearly the stiffeners compromised the handling and manouverability of the vehicle. Get back on the horn with the insurance company. The dealership which prepped the vehicle is probably partially to blame.

Sue them. You have a very strong case.... air tight, I'd say.

very strong case. they said they did something, didn't do it, and it harmed you.

yeah i'd raise hell with them. theres no way you can let something like this slide when its clear the dealership is at fault and not to mention, your life was on the line.

So what do these spring stiffeners look like and where on the springs are they located, want to make sure mine aren't still on.

Let them handle it, that is what they are there for.
