i got into an acident today

Default i got into an acident today

wow i really can't believe im posting this. i'm so shocked it's my first car accident. i bought the s on 10-31-06. well here is what happened. i was driving around with a few buddies, not speeding or anything just cruising, and i notice up ahead my buddy's back tires slipped a little on his 350z, and i started slipping too, but the car started over revving because ov the tires slipping. it started to go in one direction, so i counter steered into the other, then it spun out and went side ways as i was trying to countersteer back. i lost control and hit a guardrail. the airbags deployed and i hit the guardrail so hard that it sent me to the other side of the highway. i swear i was not speeding, i was cruising in 4th at about 2500 rpm.

as far as damage goes, the front bumper is cracked, but headlights are fine, the back bumper is dented in on one side, the front control arms could possibly be damaged, and the airbags.

so my question is how much money will i actually get from this? am i at fault? will they declare it a total loss? how much do you think the insurance will quote me in repairs.
the car was an 01 with 75k. i was quoted that it was worth 18k, bought it for 15,500. and i put 5,500 down when i bought the car.

what caused the spin? wet pavement? ice?

Sorry to hear about this bro. Good Luck with what happens next.

From the details you wrote, this will be an at fault accident. Depends on whether we got the full details from you, what the police report says, etc. But if there was no other vehicle involved and no animals hit, then it is at fault. You caused a one car accident, no one else is to blame. Insurance Co can't sue the ground or the weather conditions.
Your insurance will take over from here and pay out whatever they deem best. If the car will require repairs close in dollar amount to the value, they might call it a total and pay you the value of the car. You can then try to negotiate and buy the car back from them, etc.

Not much else to say based on what you wrote. Hope you called your Ins Co immediately so they could start the process of handling the claim. What company do you have?

Sorry to hear, but glad that it sounds like you are alright.

Like I've mentioned in previous threads, I think that if the airbags deploy, it's often considered totaled regardless. Depends on the insurance company though.

I havent had any specific experience in this type of accident, but I would imagine that you would be found at fault unless there is some obvious evidence to adverse road conditions (ice). If that were the case though, they might question as to why you were not driving in a way to compensate. You make it sound like you were travelling pretty fast to hit the rail hard enough to throw you to the other side of the road.

Insurance will send out an adjustor who will advise them/you as to the cost to fix, and then insurance will determine if it exceeds their cost/value percentage (75-80% of the value of the car). If so, it's totalled, if not, then you get it fixed.

I dont want to nitpick, but why are you swearing that you werent speeding to us? We arent writing the police report

I wish you all the best in getting things taken care of though.

Good luck with your insurance co., it'll be up to them if they total the car. Do you have any pics of the damage? The main thing is your not hurt.

well it did snow the night before but the snow had dried up by the time i was driving. there was some black ice on the road that i did not see.
i wasnt traveling on a regular street, it was on an overpass so the speed limit is like 40 i was going somewhat this speed.
i dont have statefarm or anything like that we have small local companies we insure thru.
more questions? how does gap insurance work

Sorry this happened to you but if you let it over rev when you hit the slick stuff you will most likely have to take the blame. That doesn't change the fact that you crashed your car, nearly soiled your seat, and could have been hurt badly. I'm sure glad it wasn't any worse for you. My guess is that the car will be totaled. With just a little luck you'll get a payoff that will allow you to get another S2K.

2500rpm in 4th gear would put you at 32.5mph... and you smashed THROUGH the guard rail (at least thats what It sounds like)?

Anyway, do you have snow/winter tires? Summer times in this cold w/ black ice on the road = huge

Regardless, you are certainly at fault based on your story. Insurance doesn't care one bit about road conditions as you're supposed to drive accordingly with the proper tires. In fact, if a cop came to the scene, I would be thankful he didn't give you a ticket for driving too fast for conditions.

No one can tell you how much repairs will cost, or if it will be declared a total loss, but as mentioned above, deployed airbags are step in this direction since they are very expensive to repair. Generally Insurance companies will total the car if the damage is 80% of the assessed pre-accident value, or if the cost of repairs minus the salvage value is higher than that value.

Similar thing happened to me a few years back no guard rail but I managed to roll my car. No one else involved going less than 30 and hit some black ice. I got slapped with a driving unsafe for road conditions ticket and points. It sucks but learn from mistakes, be happy you are still here and make the best of it.
