I don't know if this is the correct section, but I think I've seen a similar thread posted here.

So, I ordered an item from a seller on s2ki. I paid $100 on 3-24-09, and $275 on 3-26-09. He said he would ship it out within 1.5-2.5 weeks. He has had some personal problems in his life come up, and so he hasn't been able to ship the item. His brother has PMd me from his account (In early April) and said it is all boxed and ready to go and everything.

I asked for an update after it had been more than 2 weeks since I received the PM from his brother, "hey i need an update on this, either an ETA of when it will be shipped or a refund. been 2 weeks with no word..."

So the last PM I got from the seller was on May 1, 2009 after I opened a PayPal dispute, explains a little more about the personal problems and says "i will send you the ****in money so dont **** with me im not in the mood for some punk kid."

It's been almost 2 months from when I sent the payments, and I think if I wait too much longer I won't be able to just get the money back through my credit card company.

Would I be out of line in contacting the credit card company to get that money back?

I always give people a 1 week grace period, then I try to get my money back. The "personal problem" BS story is all too common. If someone agrees to send something in 1.5-2.5 weeks and you dont receive it by then then you ask why and say you will give them one more week or refund your money. If your product and money doesnt come back in a week, file a complaint with paypal and credit card company.

Yeah I wanted to gather OT's input on the situation, as well as the people who visit the seller feedback forum.

I'll try to close the other thread then, I feel I'll get better responses in this section.

My friend was put into the same situation before he contacted his credit card company and they refunded his transaction.

There may be legitimate family problems for the seller, but if so he should just send your money back if he's too busy. I'd nip it in the bud and tell my credit card company to charge back.

No, it would be appropriate for you to try to cancel the credit card transaction immediately (though it's probably too late).

You sent this guy $400 two months ago and he can't take 15 minutes to box and ship your item? Then he threatens you and calls you a punk? Even if he isn't a scammer I wouldn't want to do business with that a-hole.
