He can only go by what the lawyers say at this point. The state cannot prove intoxication without the breatalyzer unless the officer was very thorough with his paperwork and testimony. It was a university cop, and the paperwork is not detailed in the least.

There is going to be some penalty associated with the refusal itself whether it be a fine, community service or an interlock.
