Default Speeding ticket help

i just got a ticket today(my first one ) for doing 60 in 35. it was supposed to be reckless but he only gave me a speeding ticket. the thing is, he clocked me on his motorcycle(while he was moving) from the other side of the median going the other way. is that even possible(while we were both moving towards eachother)? i wasnt thinking right at the time and forgot to ask him if he could show me the radar gun. anyways, what do you guys think i should do? fight it or pay up? i dont care about the cost of the ticket, its the points that going to kill me(i think). i currently have +3 good driving points and with the 4-point ticket, that'll take me down to -1. will that affect my insurance by much?


is there anyone i can talk to over the phone to atleast not give me any points. ill be happy to just pay for the ticket itself with no points. btw this happened in fairfax city if this makes a difference.

Yes they can clock you while their driving in the other direction. I don't know VA law but most times around here if you just go to court they will drop the points...

Unless you can legitimately defend yourself (prove you weren't speeding) you will loose if you plead not guilty. The judge will believe the cop, and rightfully so.

If you plead guilty, the judge will almost certainly lower the penalty. At least in MD, it's generally better to go in with your tail between your legs. Also, you want to postpone your trial date, that way it's less likely the officer will show up.

Yes they can clock you moving in the opposite direction. In fact this is, in many cases, a preferred method of using Radar. Also in VA the officer does not have to prove or show proof (ie: store your registered speed) of your captured speed by Radar.
If I were you I would just pay. I've sat in Traffic Court many times in Fairfax and it's not a pretty picture...

I had my fair share of tickets during my brief residence in VA. I'm sorry to inform you but unlike MD the VA court system cannot reduce points on your license. This responsiblity is handled by the DMV.

OK, since we didn't talk on the phone razor, I will just tell you this. No matter how innocent you are, chances are greatly against you that going to court will not do you any good. And like teh previous poster said, there are no deals or ways out of your ticket or points. The best you can do might to get probation, that is, if you don't get any tickets in 6 months then they will drop teh first one.

Ka radar can clock you while standing still.. Moving towards you, or away.

In Fairfax Co VA you go to court and a prosecutor will prosecute you and the judge will throw the book at you without even a glace at you. Its like 2 on 1 in that court room. Only way out of a ticket in traffic court I've seen is:

- If the police officer doesn't show up.
- If you go in military uniform.
- If you are a fireman, paramedic, etc. and show up in uniform.
- You hire an EXPENSIVE lawyer. A regular lawyer is almost useless in fairfax co VA courts.

You can reduce your points by taking a all day driver safely course from the DMV. I think you get credited either 3 or 5 points after taking the class. But the insurance company will still see the record of your speeding ticket even if you have good points on your license.

I'm not a lawyer, I just spend too much time in traffic court..
