arrested for DUI twice in six hours

Ok so stupid question.
Now the article is not specific about what his state was when the released him but
if you have a guy in custody for DUI do you the cops have an obligation to ensure that he is sober before they release him?

Article says:
"After he was processed, he was released to his girlfriend."

So seeing how he was picked up in the custody of another adult... all bets are off. Hopefully the guy loses his license we definitely don't need people like him on the road.
