walmart sues brain damaged employee

ok here's the short of it.

employee gets hit by truck.
she has permanent brain damage and will require lifetime of nursing home care.
she sues trucking company and gets $417,000 after lawyers piece.
Walmart has sued her and won to recover $470,000 medical costs covered by her insurance.

oh and it gets better, her son died in Iraq a week after winning the trucking company lawsuit.
but due to the nature of her injuries, she can't remember that fact.
so every day she asks how her son is doing and has to be told that's he is dead.
she gets to live through the shock of learning her son has died every day.

and you ask why I hate Walmart?

This stuff happens and it is not a walmart only issue.

Whenever someone wins a law suit due to an accident, whatever insurance company or other company paid for the plaintiff's medical expenses is entitled to recoup the cost of medical payments from the award.

The real A-hole is the poor lady's lawyer, who should have explained this to her so they could have gone for money that would have been above the medical expenses that walmart was entitled to.

The same thing happened to a co-worker of mine after being in a terrible car crash. His lawyer went for enough cash that the city took their share and he still had some left though.

the fine print in the contract stated that if she was paid by an insurance settlement they could re-coup the costs

was she bran dead when she signed it

Wal-Mart Still sucks they dont like to pay their employee's... i know i use to work for them sometime back b4 i graduated.....

I hate how they never open all of the 50 registers so that you have to wait in line at one of the 4 our of 50 that ARE open.

Good bad or otherwise....Walmart did what it had to do and within its legal rights. They certainly didn't do it for the money...but to protect themselves.

If they didn't go after those funds, think of the thousands of other cases of Walmart employees in the same situation. Walmart can't selectivly decide which settlement to recoup from...they have to do them all.

I did have a good solution.....Walmart creates a family charity and donates $470,000 to it. Legal needs satisfied, Moral needs satisfied.

Walmart has no morality... but it is concerned with PR, which this story is designed to generate lots of angry customer response, resulting in possibly them quietly dropping the actions to recover the remaining funds.
They will then plant a few trees spending $100 then spend 5 million on commercials to let you know about the trees they planted...
