I'll try calling Josh again this afternoon and if he still does not pick up his phone, i'll call Nick and discuss this matter in detail because after all - the funds went to Nick's account so he is ultimately responsible

this isn't looking good -

did ebay give you the seller's address?

says "isn't ebay refunding the money" - NO sorry Nick but there wasn't enough funds in your account

Nick and or his buddy never actually had the fenders.. even though they said they did

says he is going to call me back after he goes to his buddy's home - if i don't hear anything today i would suggest a lawsuit

Josh called me back - same old BS story paypal froze the account etc etc - stated he will contact paypal now and see if the funds can be released.. he wants till Friday

I explained at this point you are out your money and no fenders BUT if this is not resolved by Friday - we will file a claim against Nick since it's his paypal account

very very shady

Ebay would not release the sellers address if it is not already stated in his account and this is due to their privacy policy. The same goes with Paypal when I asked them for Nick's address.

I'm checking to see how I can file a claim against Nick since I am from CA and not sure how out of state lawsuits are handled and processed.

I'd talk every dispute path possible, Ebay, Paypal, Lawsuit, and Criminal Complaint. The dollar amount may be at a felony level for some serious leverage.

Maybe this is a theft that could be reported to the Pawtucket Police Department. I'm not sure they're the right agency to contact since this whole deal went across state lines. However, I'm sure it's a good place to start.
