Regardless, my attorney for my business is always waiting on retainer. he wouldn't even charge me much for something as trivial as this BS

Read up on articles around the web - search ArsTechnica.com - More often than not these cases get thrown out in recent months. Their main objective is to scare you into paying the $3500 up front, but it's "illegal" for them to centralize the case to a specific area. I would stop torrenting though, or atleast learn how to hide what you are doing if you are insistent upon doing so.
I wouldn't begin to worry until you get a personal letter.

Copyright infringement isn't theft. It's copyright infringement. People shouldn't call it theft to make it sound better. In my opinion, it makes them lose credibility.
