I watched the video just to see if she wore it. Never happened....I'm sad now.

She started working there, THEN they implemented the new dress code. She was not pleased. She filed a written complaint to the management. THEN her hours were reduced. THEN she was fired. The issue is the termination "without cause." If they simply said some crap about her stealing, or not working, or that they needed to shrink the size of the crew, they'd have totally gotten away with it. The issue is, she actually had a legitimate (-enough) paper trail.

Hopefully the lawyers all have a nice conversation, and there's an out of court settlement for the amount of lost hours between her original shifts and the point of termination, skirt tips be damned.

Most wait staff work under "at-will" employment. Both parties have the right to terminate the arrangement at any time without giving a reason. You could have a claim if there are written policies the employer violated which resulted in your termination.

The situation in this case sounds more like sexual discrimination/sexual harassment/retaliation than being fired without cause. She did all the things required to address the situation, and apparently was terminated for doing so. Whether the bar is subject to sanctions or the waitress is entitled to compensation, I cannot say.

But I do know if my niece was required to wear a short skirt and work over a fan so her employer could could see her panties, I wouldn't be calling her a "stupid slut" because she had a problem with the situation.
