Default breathalyzers highly inaccurate

http://www.dwi.com/new-jersey/state-v-chun

via slashdot http://yro.slashdot.org/article.pl?sid=09/05/14/1758234

cliff notes: Guy is getting charged with drunk driving based on results of breathalyzer. Lawyers subpoena *source code* of said device, to see how accurate it is. Smart move. Code base is awful, full of bugs, including basic math... the average calculation is completely off base. Also, error handling disabled - so if something gets completely hosed internally, it'll still spit out some wrong-ass number (which may or may not end up sending you to jail). Fun stuff.

It'll be interesting to see how this ends up. There are some obvious, glaring code problems.

Sounds like they will have to throw out MILLIONS of convictions if this argument wins.

yea, they (cops) don't know how to properly administer field sobriety tests either, which can't (by the people who developed the tests) be used on people who are overweight, but juries have been bludgeoned by the information that anything is accurate. (juries expecting everything to be 100% accurate as it relates to DNA is often called the 'CSI effect')

Very true, then again I have really never seen a cop do anything right, and they are so stupid, you can get outta almost anythin by simply not giving into their "gotcha games".

Did you know they are giving pigs in Arizona 4 week crash courses in phleotomy to take blood for DUI convictions... please tell me why a medical certificate on phlebotomy takes an inteligent person 2 years but a stupid pig 4 weeks?!
