breathalyzers highly inaccurate

cliff notes: Guy is getting charged with drunk driving based on results of breathalyzer. Lawyers subpoena *source code* of said device, to see how accurate it is. Smart move. Code base is awful, full of bugs, including basic math... the average calculation is completely off base. Also, error handling disabled - so if something gets completely hosed internally, it'll still spit out some wrong-ass number (which may or may not end up sending you to jail). Fun stuff.

yea, they (cops) don't know how to properly administer field sobriety tests either, which can't (by the people who developed the tests) be used on people who are overweight, but juries have been bludgeoned by the information that anything is accurate. (juries expecting everything to be 100% accurate as it relates to DNA is often called the 'CSI effect')

Sounds like they will have to throw out MILLIONS of convictions if this argument wins.
