The rebuttal argument would be that she never sent the text because she was pulled over before she could send it.

That or she could have been looking up a website which requires the use of text entry.

I have always been curious about this law....

The Iphone is a Ipod + Phone.

What if you are changing the track on your Ipod? Will you get a cell phone ticket since technically speaking you are using an Mp3 player, and not the cell phone?

short answer: you'll get a ticket cause the cop sees you holding your phone, and whether or not you were texting won't make a damn bit of difference to him.

I say if she wasn't texting, she was wrongly accused and I would fight the ticket.

But IMO, most people aren't very good drivers when they are JUST driving. Add texting, talking, eating, etc. and their driving gets progressively worse. I am not talking about "performance" driving either. I'm talking about good ol' fashioned defensive driving.

IIRC in California it is illegal to "use" a handheld phone while driving. Good luck trying to prove that holding it while talking into it isn't using it.

Actually, these laws are very reasonable. Drivers who are too busy doing something with the phone are extremely dangerous. DWCP (driving with cell phone) has caused many many serious accidents.
