This is a post from the S4 owners forum (remember, not all states have DV):

I know a lot has been written in this forum about DV claims. But I just thought I would share a recent painful DV claim experience that has a nice ending. Maybe this will help some of you who were victims of an accident. Quick recap, my car got smashed by an idiot in a M-B ML talking on his cell phone last April. Nothing major, no injury, no airbags deployed, just a nasty hit on the frame. The Audi shop in GA took 4 months to fix the car right and (over)charged the insurance company $20k for their work. After taking the car back 5 times for touch ups (I am very picky about my S4) and calibration, I have to say it drives like a new car since last August. I submitted a diminished value claim in August. My insurer initially offered $4k. This is a typical low ball offer using the 17

That is a good outcome.

There is a guy on here right now that is struggling with a situation where the dealer wrecked his car and is lowballing him on the fix.

A DV settlement would be a great approach to his problem.

curious on what the law concerning DV is in CALI? My brother just purchased a S550 3 weeks ago and some idiot in a lifted truck back into it while it was parked. Needs a new front bumper and grille. Nothing major, but it sucks to get such a car repainted already.

Unfortunately California it doesn't exist, insurance companies owe to put the car in the physical condition it was before the accident, no more no less. Intangibles aren't covered and no insurance company here wants to be the first company to pay a DV claim because that will give legal standing for future claims.
It is unfortunate that you could be driving your perfect new car and some ass could nail you and even though your car may get fixed to better than new, when it comes time to sell you'll have a harder time.

ive always wondered about Dv. does anyone have a list of states in which you can do this?
