first of all, we were not there, and so we cannot really pass judgement on how the accident occurred and who was at fault, if any. secondly, the age of the girl is not and should not be an issue here. the only thing that matter here is that there was a collision and the doctor suffered major injuries as a result of it and he is trying to get some form of compensation for it. it's not like the guy merely got a few cuts and scrapes. he broke his collarbone. the fact that the other party involved was an 11 year old girl does not and should not automatically make the doctor a dusche bag for suing her. if the other party involved was a 27 year old man, would our perception of this case be different, even though the events leading to and the result of the accident was exactly the same??
Welcome to America, where at 11 years old, you may not be old enough to drink, vote, or stay out past curfew, but you can still fall victim to frivolous lawsuits.
Perhaps the most disturbing part of this case is that a full grown man, whom we presume to be of sound mind (due to the fact that he is licensed doctor) actually thinks that it is appropriate to sue an 11 year old child for "failing to move out of his way when he was ringing his bell and yelling at her while trying to overtake her on the road".
I submit to you that the only victims of emotional distress are the people who had to waste 10 minutes of their lives to read about his idiotic lawsuit to begin with. Perhaps we should all sue him, for wasting our time?
