Default EBay / Legal Question

About 1 month ago my computer was hacked into and someone was able to retrieve some passwords of mine to various web sites. One of those sites happened to be ebay and in the process bid on a $18k car which I ended up winning the auction for. I explained to the seller what had happened. He left me negative feedback and described me as being a "deadbeat". I had sent him a few emails explaining the situation which he was somewhat uncooperative. I proceeded to leave him negative feedback also and afterward received some very immature, threatening and derogatory comments.

The seller called me an "a--hole" stated that he would "sue me" called me a "flame", "cocky (co-kless) deadbeat", " flameing queen", "faggot" and stated that I would have some "mad big legal bills for not only leaving me a negative feedback but for breaching a contract"

My question is ... does he have any legal basis to sue me ?
I realize that anyone can sue anyone they want for pretty much any reason but does this person really have any legal ground to stand on ?

BTW they did put the car back up for sale on ebay which the 2nd person apparently backed out and now its on ebay for a 3rd time which it appears it will be sold.

Any feedback or insight would be greatly appreciated.

ebay should store your ip address for security. you should be able to trace that back to somewhat of a geographical location (unless it's AOL or something like that)

when they act like that, they don't have any legal ground to stand on. So i wouldn't worry.

If they do sue you, counter sue them for causing you trouble.

By the way, how did you know your computer was hacked into??

Make a formal statement to ebay explaining your hacked situation, make sure you change all your passwords to prevent this stuff from happening again. There is not much the other guy can do to you if you can get ebay to acknowledge that your account might have been compromised. besides, it would certainly be more trouble and costs for him to actually act on his 'threats'. He is just pissed at you because he thought he might've gotten a mad deal for his old beat-up crap-mobile. Anyways, if you have evidence that you've changed passwords for all your online accounts such as your credit card accounts, bank accounts etc, after you found out you were hacked you should be able to persuade anyone making formal queries.

Then again, I'm not a lawyer, and the law doesn't always listen to the voice of reason so everything I just typed could be worthless. Your milage might vary greatly. hehe
