Getting screwed by a dealership
On June 25th my wife and I traded in a 2003 Civic for a 2005 Accord. A few weeks later we received the monthly bill for the Civic with the payment being due on the 13th. We figured that was fine, we don't need to make the payment because we traded it in and the check must not have reached Honda Finance yet. No biggie right? Wrong.
Just for the hell of it I contacted Honda Finance on the 28th of July to see if they had received the pay off check for the Civic. They still had not received the check. So I called the dealership and they referred me to the used car sales manager (CJ). He apologized and said it was totally their fault and the check would be written that day. I said thank you very much and hung up the phone.
On Thursday the 4th of August I called Honda Finance again to see if they had received the check. They still had not received the check!! I called back to the dealership and CJ had the day off. I spoke with the person who writes the checks and he said that CJ had not even spoken with him about the incident! Meanwhile I explained the situation to him and he said he would look into and try to get the ball rolling.
The next day I called and spoke with CJ and he said the problem was taken care of yesterday. I called and spoke with the guy who writes the checks again and he still had not written a check!! So I hung up and called and spoke with CJ's boss and explained to him what was going on. He said he would look into it as well.
On Monday the 8th I called and spoke with CJ's boss. He apologized and said the check would be written that day or the next and it would sent out next day air.
We called Honda Finance on Wednesday and they still had not received a check. I called and spoke with the guy who writes the checks and he still hadn't written the damn thing!!
He promised it would be written that day and sent next day air and Honda would have it today. My wife called Honda finance today and they don't have the check.
Tomorrow our payment will be 30 days late. Honda Finance may not report it late, but some of the credit report agencies will. We acquired the Civic from my wife's cousin whom my wife cosigned for. We found out when we were with the finance guy that the credit reporting agency said there were 4 payments past 30 days late. We called Honda and they only showed 1 past 30 days, but 3 payments were made on the 30th day.
We have let Honda Finance know what is going on, but they really don't care about it. They are only concerned with getting a payment made.
Who do I need to contact to let it be known that we have gotten the raw deal from this dealership? The better business bureau? Absolutely no one I talked to at this dealership would take blame and absolutely no one has done their job!

Speak with your lawyer and have him pursue it. A friend of mine went through the same thing recently, except his lisence was revoked for not having insurance on a car he still "owned" due to the dealer never paying it off...
unfortunatly, by contract, you the account holder are responsible for payments until the loan is satisfied...
i work for a financial co, for a major car company...basically like honda financial...
and i see stuff like this all the time....
dealerships are lazy...they want the sale and thats it....they don't want to send the check, cause it's less $ out of their "monthly budget"....the dealerships only care about making the sale, they don't care where you get the $ from....
honda financial is like a bank, only they only finance cars, think of it that way....
my best advice to you and it sucks to hear, is to just make the payment before you are 30 days past due....cause then you get a mark....
any overage will be mailed back to you....so don't be worried about losing money...well technically you kind of are, if you financed cause you have paid more in interest...
if you want to keep talking about just post, cause i could talk about this all night, it's what i do for now

We needed to have made the payment today for it to not have posted 30 days late with the credit reporting agencies. If worse comes to worse, we will have to make the payment tomorrow and just hope that the agencies don't report it 30 days late.

You have a contract in the bill-of-sale. Not only in the bill-of-sale when you bought the Accord, but also when they bought the Civic from you.
As to the specifics of said contract; that's in the document, or implicit depending on the state you are in.
Since, in the U.S. posession is 9/10ths of the law, I would also go see if the title has in fact, been exchanged. Per your lawyer's advice, you could feasibly be able to report your car (the Civic) stolen. If, on the other hand, they have in fact completed the change-of-registration, you then (once again per your lawyer's advice) make payments on THEIR car. That loan is (probably) in YOUR name, but for a Civic for which you no longer own (and the registration proves so). So, that would (per lawyer's advice) entitle you to BILL the dealer for 'Inerim payment/Escrow-loan services' which, well, whaddya know, are to the tune of <insert your idea of 'fair compensation>% of your actual monthly payment.

their job is to sell cars...thats it...they'll tell you what you need to hear

The dealership is on the hook for the extra interest accrued (pay-offs are only good for 10 days) so someone there cares because they're losing money. Talk to the General Mgr and tell him no one there wants to pay off your loan. Also, if AHFC does report you late, you have docs showing that you sold the car 6/25 and that should clear it (although being a PITA).

Black marks against your credit report show up only when someone you owe money to says you didn't pay them. So if AHFC is not going to report any lates then you shouldn't have anything to worry about regarding your credit history.
