That's exactly what it is.

However, they should've confiscated the toy, and given the kid an in-house (maybe they did).

There's a couple of issues going on here:

1. The principal would've been fired for not following the policy to the letter.

2. The principal would've been shown to be lenient about the school policy, which would no doubt ruffle the feathers of some other parent, who would've had them fired. Worse, some teacher, like the theoretical outside parent, would have gotten irritated over this, nature of the facts be damned.

The principal was no doubt following procedure. Deviations from following procedures deny you protections when you get sued, common sense be damned.

i remember in elementary school a friend of mine brought a bb gun that looked like a .45 semi and the teacher asked him to give it to her and at the end of the day he got his gun and we got on the bus and went home. this was '92-'93ish

What basis would she have for sueing the school? For following the rules?

I agree that it's preposterous, but you can't sue someone for following rules. That would only make the mom an idiot.
