why was'nt your friend also charged with assault? hurtling bodily fluids is a big no-no HERE. i would have pressed the issue if someone spit on me. there's all kinds of things you can get from bodily fluids. if you spit on a cop, you are charged with assaulting an officer. your friend got off easy and maybe he won't spit on people anymore. sounds like he asked for it.

no I wholeheartedly agree that my friends response (telling the old guy "f*ck you") and then the spitting was not exactly the smartest thing to do.

People make comments like this to complete strangers all the time. So it doesn't surprise me. How you handle the situation sets you apart from the crowd.
